Resolution Regarding Ex Officio Members of the Board of Governors

 

CONSIDERATION OF RESOLUTION TO ADOPT BOARD POLICY PROVIDING FOR STUDENT EX OFFICIO MEMBER OF THE BOARD OF GOVERNORS

Resolution

BE IT RESOLVED, by the Board of Governors of Metropolitan Community College Area, that the following Policy be and hereby is adopted by the Board of governors, and inserted in the Board Policy Manual as Board Policy 11202:

There shall be a Student Ex Officio Member of the Board of Governors, who shall be elected annually for a one-year term from among and by the students of the College.  The nomination and election process for the Student Ex Officio Member of the Board of governors shall be pursuant to procedures prepared by the College's Director of Human Resources and approved by the Board of Governors. The Student Ex Officio Member may request to attend up to one conference per year within the State of Nebraska at College expense, if the conference is appropriate to the operation, governance, administration or other interests or purposes of the College, and shall be allowed to do so if the request is approved by the Chair of the Board.

CONSIDERATION OF RESOLUTION TO ADOPT BOARD POLICY PROVIDING FOR FACULTY EX OFFICIO MEMBER OF THE BOARD OF GOVERNORS

Resolution

BE IT RESOLVED, by the Board of Governors of Metropolitan Community College Area, that the following Policy be and hereby is adopted by the Board of governors, and inserted in the Board Policy Manual as Board Policy 11203:

There shall be a Faculty Ex Officio Member of the Board of Governors, who shall be elected for a two-year term each even-numbered year from among and by the full-time faculty members of the College.  The nomination and election process for the Student Ex Officio Member of the Board of governors shall be pursuant to procedures prepared by the College's Director of Human Resources and approved by the Board of Governors Policy 12402, which prohibits an employee of the College from being a member of the Board of Governors, shall not apply to the Faculty Ex Officio Member of the Board of Governors. The Faculty Ex Officio Member may request to attend up to one conference per year within the State of Nebraska at College expense, if the conference is appropriate to the operation, governance, administration or other interests or purposes of the College, and shall be allowed to do so if the request is approved by the Chair of the Board.

CONSIDERATION OF RESOLUTION TO ADOPT BOARD POLICY DEFINING PRIVILEGES OF AN EX OFFICIO MEMBER OF THE BOARD OF GOVERNORS

Resolution

BE IT RESOLVED by the board of Governors of Metropolitan Community College Area, that the following Policy be and hereby is adopted by the Board of Governors, and inserted in the Board Policy Manual as Board Policy 11204:

Privileges of an Ex Officio Member of the Board of Governors 11204

An Ex Officio Member of the Board of Governors, as defined, as defined in these Board Policies, shall be entitled to the privileges of a statutory member of the Board of Governors, subject to the following:

  1. An Ex Officio Member shall be allowed to sit with the Board and participate in discussions of agenda items, but shall not be allowed to vote on any matter coming before the Board or any committee of the Board, or to make any motion regarding any matter before the Board or any committee of the Board.

  2. An Ex Officio Member shall not be entitled to direct that any matter be placed on the agenda for a meeting of the Board or any committee of the Board

  3. An Ex Officio Member may be reimbursed for his or her duties as an Ex Officio Member of the Board, subject to the same requirements and restrictions as apply to reimbursement of expenses of statutory members of the Board.

  4. Unless otherwise required by law with respect to public records or public information, an Ex Officio Member shall not be allowed access to information that is deemed confidential by the Board.

  5. An Ex Officio Member shall not be allowed access to information that is deemed confidential by the President, unless otherwise directed by a majority of the statutory members of the Board or unless otherwise required by law with respect to public records or public information. In other respects, an Ex Officio Member shall be provided the same Board and committee meeting materials as are provided to statutory members of the Board.

  6. An Ex Officio Member shall not be allowed to participate in or attend executive or closed sessions of the Board, unless otherwise directed by a majority of the statutory members of the Board.

  7. an Ex Officio Member may not be elected as an officer of the Board or appointed as a member of any committee of the Board, but shall be allowed to attend and participate in any open meeting discussion at any Board or committee meeting.

  8. An Ex Officio Member shall not be authorized to consult with or request an opinion of College Legal Counsel.

  9. An Ex Officio Member shall observe all rules, regulations and policies applicable to statutory members of the Board, and any other conditions, restrictions or requirements established or directed by vote of a majority of the statutory members of the Board.
